With all the recent rain, flooding and landslips throughout New Zealand. This article published by Branz July 2025 gives some clear guidance to home and owners close to Geotechnically unstable land of how and why your local council may or may not grant a building consent under sections 72 and 73 of the New Zealand Building Act 2004.

It also covers the reasons and entry/notification may be added to the Certificate of Title. The two MBIE determinations sited are good examples of what is required.
